TERMS AND CONDITIONS FOR OSHWAL TRADING LIMITED (T/A STRAWBERRY AND CREAM-HOME)

These Terms and Conditions tell you the rules for using our website www.strawberry-cream.com (our Website).

By using the Website, you agree to be bound by these Terms and Conditions. The services described are provided in England and the statements made on this Website are governed by English Law.

You should read these Terms and Conditions carefully before using the Website and if you are uncertain you should either contact: info@strawberryandcream-home.com or discontinue using this Website.

1. Who we are and how to contact us

The Website is a site operated by Oshwal Trading Limited ("Company"). We are a registered limited company under company number 08680862 established under and governed by English Law and our registered office is at 12 Craigweil Drive, Stanmore, Middlesex, HA7 4TU.

2. Use

All material on this Website and unless otherwise specified belongs to the Company. 

Except as stated in the paragraph below, the contents of this Website may not be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means without the express written permission of the Company. You may not remove any trademark, copyright or other proprietary notice. 

You may print or download to disk the contents of an individual page of this Website for the purposes of private and personal non-commercial use. You may make an electronically stored, transient copy of the content of this Website for the purpose of viewing it while connected to the Internet only, however, you may only make one such copy of any content. 

3. Our Products and Pricing

Please note that all products listed for sale on our website are subject to availability.

Product images on our website are for illustrative purposes only. Please note that bed frames & mattresses come in different heights and thickness respectively. Our bedding products (e.g. Flat Sheet) may therefore fit differently on your bed, compared to what our product images illustrate. You should also bear in mind that, with the Flat Sheet, sizes become larger with a bigger bed - and therefore the edges of this product may drag on the floor at the foot of the bed if you choose to not have the Flat Sheet tucked under your mattress (i.e. leave the Flat Sheet untucked). We have also made every effort to display the colours of our images on the website to match the actual colours in the physical goods. However, the products you receive may be slightly different in colour to the images you see on our website.

Please note that we reserve the right to change product prices and product offerings without notice. The price you pay for the products will be the price displayed at the time of your actual purchase. The prices displayed on the website at any given time are only valid for that moment.

At present, we only supply goods to UK & Northern Ireland. Prices are shown in GBP, and are inclusive of UK VAT (currently set at 20%). 

4. Delivery of the Products

We offer Free UK Delivery.

Customers should allow for the following estimated lead times, from the time of purchase to when they receive the goods:

United Kingdom & Northern Ireland: Between 1-3 working days, but allow up to 5 working days.

We aim to dispatch all orders placed by 1pm (GMT) on the same day. Orders placed after 1pm (GMT) will be processed on the next working day. Orders placed on Saturdays, Sundays & UK recognised public holidays will only be processed the next working day, from these days.

Please note that you will bear responsibility for providing us with up-to-date contact details in your Customer Account or when making any enquiries.

Events Outside Our Control

An "Event Outside Our Control" means any act or event beyond our reasonable control including – without limitation – strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, snow, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster, failure of public or private telecommunications networks, impossibility of the use of motor transport or other means of public or private transport, road traffic accidents, road closures or mechanical failure.

When an “Event Outside Our Control” occurs, we will not be liable or responsible for any failure to perform, or a delay in performance of our duty to deliver the products you purchase. When such an event occurs, we will contact you as soon as possible to notify you.

5. Your Right to Cancel and Returns

We take pride when you are happy with your purchase. We are confident that you will love the quality of our bedding, as much as we do. But if you have changed your mind after receiving our products & wish to return them please call us (on 0208 954 0020) to discuss.

Alternatively you can email us at: info@strawberryandcream-home.com including your order number, the item/s you wish to return, and briefly stating your reason for return. Please include a daytime contact number (in case we need to contact you via phone).

We offer our customers FREE returns only if returning the goods back from a UK address. Please note that we only offer FREE returns to customers who purchase directly from our website.*

*Items bought during any promotional offer or sale are not eligible for a return or refund but may be exchanged.

5a) Getting a refund:

If you have not bought our products directly from our webstore, but through a retailer or other source, and you wish to receive a refund or make an exchange, please contact them directly to process your request. Please note that we will not bear any responsibility, under any circumstances, for making an exchange or refund on their behalf.

For customers who purchase directly from our website, refunds will only be made if the following criteria is satisfied:

1. The return is made within 30 days from the date when the goods are delivered and signed for as received.
2. For health and hygiene reasons we are unable to offer refunds or exchanges on any of our bedding products unless they are returned to us unused and in their original condition, fold, and packaging.

We reserve the right to inspect these goods and determine whether a refund can be made. Please allow up to 21 working days for your refund claim to be processed. We will email you, notifying whether the refund application has been successful and the amount that will be reimbursed.

5b) Returning part of your order:

Please note, that depending on your order value, discounts may already have been built in. Choosing to return some of the items may affect the discount applicable on the items you decide to keep. We will calculate the price for the items you choose to keep, and deduct that amount from the original order value. We will refund the balance to you.

5c) How to return goods:

We use the services of DPD, and will give further instructions by email on how to make a return once you contact us.

We ask that you retain all documents that show proof of posting together with tracking reference details. Items lost in transit, where proof documents are not retained, will be treated as if no returns have been made.

5d) Exchanges:

We allow exchanges to be made. Simply follow the Returns process stated above. 

Once we have received the goods you wish to exchange, we will inspect these to ensure they are unused, unwashed, and in its original condition and packaging.

Once satisfied, we will exchange these. Price differences may arise if exchanges are in relation to a different size / product request. Consequently any price difference, if it arises, may be payable by you to Strawberry & Cream – Home, or vice versa.

The new exchanged goods will be delivered to the same address stated at the time you placed the original order - unless instructed otherwise in writing.

5e) Defective Goods:

For product(s) that are defective, or other errors relating to your order, you must notify us of these within 7 days from the date when the goods are delivered to you.

We will ask whether you prefer a refund or a replacement of these goods. In either case, we will satisfy your request at no additional cost to you including costs you may incur in returning the defective products to us. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office.

6. Payment and Charges

We accept payment through major credit / debit cards, and via the Klarna payment gateway. Payment for the products and all applicable delivery charges is in advance, with the exception of payments made using the Klarna payment service – where Klarna will invoice you directly for payment after a set period, depending on their instalment payment option that you have chosen and be approved of (i.e. “Pay in 30 Days” or “Pay in 3 Instalments”). In all other cases, we will charge your debit card or credit card when we send the Confirmation Email.

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the following payment options. Payment is to be made to Klarna:

• Pay in 3 installments
• Pay Later

8. Warranty

The Company try to make sure that information contained on this Website is as accurate as possible. However, we give no warranty of any kind regarding the Website. The Company does not warrant the accuracy, completeness, currency, or reliability of any of the content or data found on this Website and expressly disclaims all warranties and conditions, including implied warranties and conditions and those arising by statute or otherwise in law or from a course of dealing or usage in trade. 

Information contained within this Website is for information purposes only.

Hypertext links enable you to access other websites on the Internet not owned by the Company. In providing these links, we do not endorse in any respect the contents of any other website, nor do we accept any liability for any such contents. We will have no liability in respect of any material hyper-linked to our Website which includes, but is not limited to, material that may be misleading, inaccurate, defamatory, threatening or obscene or otherwise not in accordance with applicable law or regulations in force from time to time. 

9. Liability

The Company assumes no responsibility and shall not be liable for any damages to, or viruses that may infect, your computer or other equipment or other property on account of your access to, use of, or browsing in the Website. In no event shall the Company be liable for any injury, loss, claim, damages, or any exemplary, punitive, direct, indirect, incidental or consequential damages of any kind (including but not limited to lost profits or lost savings) whether based in contract, tort, strict liability, or otherwise. The entire risk as to the quality, performance and use of this Website is with you. Any communications, messages and other information obtained while using the Website is obtained at your risk and you bear the entire responsibility for any losses that you may experience as a result of your use of our Website.

You shall indemnify and keep the Company indemnified against all actions, claims, losses, costs (including all legal costs actually incurred or otherwise), damages and expenses that are suffered or incurred by the Company whether or not reasonable or otherwise foreseeable or avoidable which arise directly or indirectly from any breach or alleged breach by you of any of these Terms and Conditions.

The display of any trademark on this Website does not imply that any license has been granted by its owner. No trademark infringement is intended and no suggestion is made that the owner of the trademark endorses our product or services. Equally, our display of the trademark does not constitute an endorsement or approval by us of the trademark owner, its Website or its product and/or services.

These terms of use refer to the following additional terms, which also apply to your use of our Website:

• Our privacy policy. We will retain data about you which we obtain as a result of you visiting this Website. We may use that information to provide you with details of products or services (whether provided by us or others) which we believe may interest you, unless you indicate at the relevant part of the Website to the contrary. You agree that your registration data and other information provided by you will be processed in accordance with our privacy policy.

If any part of these Terms and Conditions for any reason is declared invalid by a court of competent jurisdiction, this will not affect the validity of any remaining part of the Terms. Any such remaining part will remain in full force and effect as if the invalid part of the Terms had been eliminated.

Your access to and use of our Website may be terminated by us by notice with immediate effect at any time and for any reasons or no reason. 

15. Changes to these Terms and Conditions

We reserve the right to make changes to these Terms and Conditions at any time. Your use of the Website following such changes constitute your acceptance of these changes. Every time you wish to use our Website, please check the Terms and Conditions to ensure you understand the terms that apply at that time.

16. Entire Agreement

These Terms and Conditions, together with those incorporated herein or referred to herein constitute the entire agreement between us relating to the subject matter hereof and supersede any prior understandings or agreements (whether oral or written) regarding the subject matter.

These Terms and Conditions shall be governed and interpreted in accordance with the laws of England and Wales.
